Brian Fahey

An experienced litigator and adviser, Brian focuses his practice on litigation, nonprofit advising, and government and election matters. Brian has litigated a wide variety of commercial claims in state and federal courts around the country.

Brian is especially experienced in construction matters, having successfully argued multiple construction-related suits to verdict at both jury and bench trials. In addition to favorable verdicts, he has secured awards of attorney fees for his clients under the Nebraska Construction Prompt Pay Act and the Nebraska Seller Disclosure Statutes.

Beyond litigation, Brian is passionate about assisting and advising nonprofit organizations in all stages of formation and growth. He boasts years of nonprofit experience as an attorney, board member, and former nonprofit manager. He currently sits on the Board of Directors for the River City Mixed Chorus and the Tri-Faith Initiative in Omaha. Prior to law school, he worked as the General Manager for a nonprofit arts organization in Minneapolis.

Brian also advises clients on government matters, ballot initiatives, and election issues. Previously, Brian was part of a team that successfully litigated a highly publicized public records request and trial against the State of Nebraska. Before law school, Brian worked on various local and statewide political campaigns in Nebraska and Minnesota, both as a field and finance director.

Brian graduated from the University of Nebraska College of Law, High Distinction, Order of the Coif, and Order of the Barristers. In law school, he was the 2015 Theodore Sorensen Fellow and an Executive Editor of the Nebraska Law Review. Following law school, Brian clerked for the late Hon. Laurie Smith Camp, Chief U.S. District Court Judge for the District of Nebraska.
